Re some issues of delimitation of the seabed and subsoil of the Caspian Sea
- I’d noted that the overall tone of the article is incorrect the giving Turkmenistan's position on the issue of delimitation of the seabed and subsoil of the Caspian Sea between the two countries as an attempt to pressure on Azerbaijan is regrettable because it does not correspond to the relations linking the friendly people. It is hoped that such an interpretation of Turkmenistan's efforts to explain the real situation is a special case of ill-considered statements
As all do know the delimitation is reached by agreement between the two countries based on the decision of the parties and not unilaterally. Due to the of agreement on the delimitation of the seabed and subsoil of the Caspian Sea between Azerbaijan and Turkmenistan the work carried out in the fields of Omar and Osman consortium AIOC are illegal. However the Azerbaijani side continues to carry out these works, despite the protests of Turkmenistan.
The position of Turkmenistan in accordance with which the bed and subsoil of the Caspian Sea between Azerbaijan and Turkmenistan should be demarcated along the median line and taking into account all factors and circumstances that are present in the area of separation entirely consistent with international law. There is a controversial area of differentiation is not achieved an acceptable solution for both sides and in the area of Azerbaijan is production of hydrocarbons. Turkmenistan's only on the total conducting research in the field Serdar which is fully in line with the median line constructed in accordance with principles of international law is in the Turkmen sector of the Caspian Sea. Azeri expert also mentioned that according to Law of the Sea "who discovered, he is claiming". Such a provision in law of the sea does not exist.
If we keep in mind the fact that deposits in the Caspian Sea discovered by Azerbaijani geologists the other thing should be noted: that they were open at a time when both countries were part of the Soviet Union, respectively among which were people of different nationalities. And if the Soviet geologists Azerbaijani by origin took part in the discovery of deposits, for example, in Siberia, does that Azerbaijan claims on them? It is absurd.
In accordance with the Treaty of Friendship and Cooperation between Turkmenistan and Azerbaijan which was concluded in 1996 the parties agreed that they would resolve disputes in accordance with Article 33 of the UN Charter which lists the methods of peaceful settlement of disputes. One such method is negotiation. The negotiations on the delimitation of the seabed and subsoil of the Caspian Sea between Azerbaijan and Turkmenistan continue in 1998.Turkmenistan put forward specific initiatives to address this issue but received no response from the Azerbaijani side. In the futility of negotiating parties to the proceedings could be the solution to the current dispute. In this case the quite honest desire to work together is sufficient to solve the dispute existing between the two countries in accordance with accounting principles generally accepted in the civilized world. Turkmenistan made it clear that will take any decision made by the Court.
In summary the initiative of Turkmenistan in accordance with which it is proposed to solve the existing disputes by peaceful civilized way in accordance with international law fully complies with the principles of good neighborliness and cooperation initiative.
